Terms of Service
What you can expect when you create, receive and share a personal song.
Version 2026-10-03-draft-2 · reviewed 3 October 2026. These are proposed policies, not an active contract. Seller details, effective dates and marked business decisions must be confirmed before launch.
Seller and eligibility
The seller is identified on Seller & Contact Details. Purchasers and account holders must be at least 18 and able to enter a contract. A gift may celebrate a younger recipient without giving that child an account. Do not submit unnecessary information about children.
Your purchase
You are paying for personalized production and the permitted use of the finished digital gift. You receive a personal, non-commercial license, not ownership of copyright or a promise of exclusive rights. The Song Licence describes gifting, downloads and personal social sharing.
AI-generated music
The planned production service uses Google Lyria. AI outputs may resemble other outputs or existing material; uniqueness, copyright registration and exclusivity are not guaranteed. Human-authored contributions may have separate rights. See AI Disclosure.
Content you submit
You confirm you have the rights and permissions needed for your lyrics, stories, names, recordings and photographs. You retain rights you already hold. You grant Wishly and its authorized production providers a limited, non-exclusive license to process those materials to fulfil, support and legally administer your order. This is not permission to use your memories in advertising or to train AI; any such use requires a separate lawful basis and disclosure. Provider data handling must be confirmed in the Privacy Policy before launch.
Acceptable use
Request genres, moods and vocal character rather than impersonation of named artists or real people. Do not submit infringing lyrics or recordings, harassment, threats, hate, sexual content, exploitation, deception or private information without permission. Do not attempt to bypass safety controls or remove provenance markings. Applicable provider restrictions, including the Google Cloud Acceptable Use Policy, also apply to requests processed through that provider.
Price and payment
US purchases display USD; other supported markets show their selected currency. Mandatory fees must be included in displayed pricing, and applicable tax and the complete total must be shown before payment. Stripe is planned for global payments and Razorpay for India. The prototype does not calculate tax or accept payment. Orders start only after server-side payment verification and acceptance of the active policy versions.
Production, changes and refunds
Check names, pronunciation, facts and musical choices before submitting. The package must state its delivery estimate and included correction/regeneration allowance before payment. Those values are not yet approved. Problems are handled through Customer Support and the Refund & Cancellation Policy. Nothing here removes mandatory consumer rights.
Warranties — proposed wording
To the extent permitted by applicable law, the service is provided as available and without additional implied warranties. Wishly does not guarantee commercial suitability, exclusivity or copyrightability. This clause does not exclude statutory quality obligations, remedies, or any warranty that cannot lawfully be excluded.
Liability and indemnity — counsel review required
A monetary liability cap, excluded loss categories and exceptions have not been selected. Proposed indemnity would cover third-party claims caused by unlawful customer submissions or misuse only to the extent lawful; it must preserve non-waivable consumer protections. These provisions require counsel-approved wording and are not operational restrictions in this draft.
Disputes, arbitration and governing law — not activated
The seller jurisdiction, governing law, venue and dispute-resolution process are undecided. The requested arbitration/class-action-waiver proposal needs a named administrator, rules, fees, consumer exceptions, small-claims treatment, notice address and review for each selling region. If adopted, the proposed 30-day opt-out must be usable without losing the purchase. No arbitration agreement or class-action waiver is active in this draft.
Accounts and termination
Wishly may suspend unlawful or abusive use, with notice and review where required. Legitimate unresolved purchases and statutory remedies must still be addressed. A termination decision must not silently revoke a lawful purchaser’s access without the applicable policy and legal basis.
Changes, severability and contact
The policies accepted with an order remain available in Policy Versions. Material changes must be communicated through an appropriate account or email notice, with renewed acceptance where required. If a clause cannot be enforced, the remaining lawful terms continue. Use Seller & Contact Details for notices.
